Chapter 29

א ור"א אומר אף במקום שאסרו לייחד מותר למכור מאי טעמא עובד כוכבים חס על בהמתו שלא תעקר ואף רב הדר ביה דאמר רב תחליפא א"ר שילא בר אבימי משמיה דרב עובד כוכבים חס על בהמתו שלא תעקר:
1 But R. Elazar said: Even in a place where it is forbidden to leave them together it is permitted to sell. Why? The idolater cares that his beast will not become sterile. And Rav too changed his opinion for R. Tahlifa said in the name of R. Shila b. Abimi, who said in the name of Rav: An idolater cares that his beast will not become sterile.
ב ובכל מקום אין מוכרין בהמה גסה כו': מ"ט נהי דלרביעה לא חיישינן מעביד ביה מלאכה חיישינן
2 In all places it is forbidden to sell them large animals etc. What is the reason for this? While we may not fear bestiality, maybe there is the fear of his making the animal work [on Shabbat]?
ג וניעביד כיון דזבנה קנייה גזירה משום שאלה ומשום שכירות
3 Then let him make it work; since he has bought it, he owns it! The prohibition is because of lending and because of renting.
ד שאלה קנייה ואגרא קנייה
4 [But, surely] when he borrows it he owns it, or when he rents it he owns it [during that period]!
ה אלא אמר רמי בריה דר' ייבא גזירה משום נסיוני דזמנין דזבנה לה ניהליה סמוך לשקיע' החמה דמעלי שבתא וא"ל תא נסייה ניהליה ושמעה ליה לקליה ואזלא מחמתיה וניחא ליה דתיזל והוה ליה מחמר אחר בהמתו בשבת והמחמר אחר בהמתו בשבת חייב חטאת
5 Then said Rami the son of R. Yeba: The prohibition is because of ‘trying [the animal out].” For sometimes it might happen that he sells it to him close to sunset on the eve of Shabbat and he might say to him, “Come let me try it out,” and hearing the owner’s voice it will walk because of him, and he indeed desires it to walk, so that he acts as a driver of his beast on the Sabbath and he who drives his beast on Shabbat is liable for a sin-offering.
ו מתקיף לה רב שישא בריה דרב אידי ושכירות מי קניא והתנן אף במקום שאמרו להשכיר לא לבית דירה אמרו מפני שמכניס לתוכו עבודת כוכבים ואי ס"ד שכירות קניא האי כי קא מעייל לביתי' קא מעייל
6 Shisha the son of R. Idi objected: But does renting cause an acquisition? Have we not learned, “Even in a place where they said it was permitted to rent [a house to an idolater], they did not say it in regard to a dwelling house, because he will bring idols into it.”
ז שאני עבודת כוכבים דחמירא דכתיב (דברים ז, כו) ולא תביא תועבה אל ביתך
7 It is different with idols, for this is a strict matter, as it is written, “And you shall not bring abomination into your house” (Deuteronomy 7:26).
ח מתקיף לה רב יצחק ברי' דרב משרשיא ושכירות מי קניא והא תנן ישראל ששכר פרה מכהן יאכילנה כרשיני תרומה וכהן ששכר פרה מישראל אע"פ שמזונותיה עליו לא יאכילנה כרשיני תרומה
8 Yitzchak the son of R. Mesharsheya objected: But does rent really constitute acquisition? Have we not learned: An Israelite who rents a cow from a priest may feed it terumah vetches; but a priest who rents a cow of an Israelite, even though he is obligated to feed it, may not feed it terumah vetches.
ט ואי ס"ד שכירות קניא אמאי לא יאכילנה פרה דידיה היא אלא ש"מ שכירות לא קניא והשתא דאמרת שכירו' לא קניא גזירה משום שכירות וגזירה משום שאלה וגזירה משום נסיוני
9 Now, were we to hold the opinion that renting constitutes acquisition, why should he not feed it? Surely the cow belongs to him! From here you can deduce that renting does not constitute acquisition. Now, since you have declared that renting does not constitute acquisition, the prohibition is both because of “renting,” and because of “lending” and because of “trying.”
י רב אדא שרא לזבוני חמרא אידא דספסירא אי משום נסיוני הא לא ידעה לקליה דאזלא מחמתיה ואי משום שאלה ושכירות כיון דלא דידיה היא לא מושיל ולא מוגר ועוד משום דלא ניגלי ביה מומא
10 Adda permitted selling a donkey [to an idolater] through an agent: If we are concerned about “trying,” it is not familiar with his voice that it should walk because of him. And as to “lending” or “renting” since it is not his own he will neither lend nor rent it; Also, lest some fault be discovered in it.
יא רב הונא זבין ההיא פרה לעובד כוכבים אמר ליה רב חסדא מ"ט עבד מר הכי אמר ליה אימור לשחיטה זבנה
11 Huna sold a cow to an idolater. R. Hisda said to him: Why did you act in this way? He replied: I assume that he bought it for slaughtering.
